Welcome to Keepsakely. These Terms of Service ("Terms") apply when you visit our website, create an order or otherwise use our services (the "Services"). "We", "us" and "our" mean Keepsakely. By using the Services you agree to these Terms, our Privacy Policy, Refund Policy and Shipping Policy. If you don't agree, please don't use the Services.

1. Eligibility and accounts

You must be at least the age of majority where you live to place an order. You agree to give accurate, current and complete information when you order, and you are responsible for keeping any account details secure.

2. Our products

Keepsakely sells personalized items that are made to order. Colors on screen may differ slightly from the finished product, and print placement may vary slightly. Product images and previews are for illustration. We may change or discontinue products and limit quantities at any time.

3. Your photos and designs

When you upload a photo, image or text ("Your Content"), you confirm that:

you own it or have all rights and permission needed to have it printed, including permission from anyone identifiable in it;
it doesn't infringe anyone's copyright, trademark, privacy or other rights; and
it is not unlawful, hateful, threatening, sexually explicit, or otherwise objectionable.

You give us and our production partners a limited, non-exclusive license to use Your Content only to review it, produce your order and handle any related support or replacement. We don't use Your Content for advertising without your permission. We may refuse, cancel or remove any order that contains content we believe violates these Terms or the law, and we will refund you if we cancel your order for that reason. You are responsible for Your Content and agree to cover claims that arise from it, to the extent the law allows.

Please check the preview before you order. We print what you approve, and we are not responsible for the way a low-resolution or poorly cropped image prints.

4. Orders and acceptance

Placing an order is an offer to buy. We may accept or decline any order, and your order is accepted when we confirm it. Because items are made to order, changes or cancellations are possible only before production starts. See our Refund Policy for details.

5. Prices and payment

Prices are in U.S. dollars unless stated otherwise and may change without notice. The price you pay is the price shown when you place your order, plus any shipping and taxes shown at checkout. You confirm that you are authorized to use the payment method you provide. If we find a pricing or listing error, we may correct it or cancel the affected order and refund you.

6. Shipping and delivery

Production and delivery times are estimates and not guarantees. Risk of loss passes to you when the carrier receives your order. See our Shipping Policy for details.

7. Returns and refunds

Because every item is custom made, returns are limited to the cases described in our Refund Policy.

8. Intellectual property

The Keepsakely name, logo, website content, product designs, text and graphics belong to us or our licensors. You may use them for personal, non-commercial purposes only. You may not copy, resell or reuse them without our written permission. Nothing in these Terms transfers ownership of Your Content to us.

9. Prohibited uses

You agree not to use the Services for any unlawful purpose, to upload malicious code, to scrape or interfere with the website, to impersonate others, or to try to bypass security features.

10. Third-party tools and links

Our Services use third-party tools, such as Shopify and print-on-demand providers, and may link to other websites. We don't control and aren't responsible for third-party services or sites.

11. Relationship with Shopify

Keepsakely is powered by Shopify. Any purchase you make is made directly with Keepsakely, and Shopify is not responsible for any aspect of it.

12. Disclaimer of warranties

The Services and products are provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. Some places do not allow these limits, so they may not apply to you.

13. Limitation of liability

To the fullest extent the law allows, Keepsakely and its owners, employees and partners are not liable for indirect, incidental, special or consequential damages, or for lost profits or data, arising from your use of the Services or our products. Our total liability for any claim relating to an order is limited to the amount you paid for that order.

14. Indemnification

You agree to defend and hold Keepsakely harmless from claims, losses and expenses (including reasonable legal fees) arising from your breach of these Terms, Your Content, or your violation of any law or third-party right.

15. Termination

We may suspend or end your access to the Services at any time if we believe you have violated these Terms. Sections that by their nature should survive termination will continue to apply.

16. Governing law

These Terms are governed by the laws of the State of Michigan, United States, without regard to conflict-of-law rules. You agree to the exclusive jurisdiction of the state and federal courts located in Michigan for any dispute.

17. Changes to these Terms

We may update these Terms from time to time by posting the new version on this page. Your continued use of the Services after a change means you accept it.
